Terms and Conditions of Sale and Website Use

These Terms and Conditions apply to the use of lovelystickers.com and to all purchases made from Lovely Stickers.

By using this website or placing an order, you agree to these Terms and Conditions. Mandatory consumer rights applicable in your country remain unaffected.

1. Scope

These Terms and Conditions apply to consumers and business customers purchasing products or services from Lovely Stickers.

Additional terms displayed on a product page, custom-order quotation, design approval or checkout page form part of the contract.

In the event of a conflict, mandatory consumer law takes priority over these Terms and Conditions.

2. Products

Lovely Stickers sells decorative stickers, decals, adhesive skins, wraps, lettering, custom designs and related products.

Product photographs, mock-ups and digital previews are provided to illustrate the general appearance of the product. Colours may appear slightly different depending on the customer’s screen, lighting, material, finish and printing process.

Minor variations inherent in printing, cutting, laminating or manufacturing are not considered defects unless they materially affect the appearance, compatibility or normal use of the product.

3. Compatibility and product selection

The customer is responsible for selecting the correct product, model, version, size, design and options for their equipment.

Compatibility information displayed on the product page forms part of the product description. Customers should contact us before ordering when they are uncertain about compatibility.

A product that correctly matches the model and options selected by the customer is not considered defective solely because the customer selected the wrong model, size, finish or configuration.

This does not apply where the error results from incorrect or misleading information provided by Lovely Stickers.

4. Orders

Before submitting an order, the customer can review the selected products, quantities, options, delivery address, shipping method and total price.

By confirming the order, the customer makes a binding offer to purchase the selected products.

An order confirmation is sent electronically after the order is placed. Acceptance remains subject to successful payment, fraud screening and our ability to fulfil the order.

We may cancel an order where:

• payment is refused or reversed;
• fraudulent or unauthorised activity is suspected;
• the product cannot reasonably be manufactured or supplied;
• the order contains unlawful, abusive or infringing content;
• an obvious pricing, technical or description error has occurred;
• the delivery destination cannot be served.

If we cancel an order after payment, the relevant amount will be refunded using the original payment method.

5. Prices, taxes and shipping costs

Prices may vary depending on the customer’s country, market, currency and applicable taxes.

Before the order is confirmed, the checkout displays the product price, available shipping methods, applicable taxes and the total amount payable.

Shipping costs are calculated according to the destination, products, parcel characteristics and selected shipping method.

For deliveries outside the European Union or other applicable tax area, import duties, customs fees, brokerage charges or local taxes may be payable by the recipient unless they were expressly collected during checkout.

6. Payment

Available payment methods are displayed at checkout.

Payments may be processed by third-party payment providers, including Stripe and other providers made available through the Shopify checkout.

Lovely Stickers does not directly receive or store the customer’s complete payment card details.

The customer confirms that they are authorised to use the selected payment method.

7. Made-to-order and personalised products

Many Lovely Stickers products are printed, cut, laminated or otherwise manufactured after an order is placed.

Some products are also made according to individual customer specifications or are clearly personalised. These may include:

• products containing a customer’s name, text, initials or personal race number;
• products incorporating a logo, photograph, design or file supplied by the customer;
• products made to bespoke dimensions outside the standard catalogue options;
• designs created or substantially modified specifically for the customer;
• products manufactured according to individual written instructions.

Products that are genuinely made according to the customer’s individual specifications or clearly personalised may be excluded from the statutory right of withdrawal, as explained in our Returns, Withdrawal and Refund Policy.

8. Customer-supplied information and files

The customer is responsible for checking all names, numbers, text, spelling, dimensions, colours, model information, files and instructions supplied to Lovely Stickers.

Where a preview or proof is provided, the customer must carefully review it before approval.

Once a design has been approved, Lovely Stickers is not responsible for an error that appeared clearly in the approved proof, unless the final product differs from that proof.

9. Intellectual property supplied by customers

By supplying a logo, image, design, photograph, file, trademark or other content, the customer confirms that they have the necessary rights and permissions to use and reproduce that content.

The customer must not request the production of content that is unlawful, defamatory, discriminatory or infringes the intellectual property rights of another person.

Lovely Stickers may refuse or cancel an order where the requested content appears unlawful or infringing.

10. Production and dispatch

Most products are made to order. Production and dispatch times may vary according to the product, order quantity, required design work and current workload.

Any production or delivery period displayed before purchase is an estimate unless it is expressly described as guaranteed.

We will dispatch orders without undue delay and within the period communicated to the customer. Mandatory rights relating to delayed delivery remain unaffected.

11. Delivery

Orders are delivered to the address entered by the customer during checkout.

The customer must verify that the delivery address is complete and accurate before confirming the order.

12. Transfer of risk

For consumer orders, the risk of loss or damage remains with Lovely Stickers until the customer, or a third party designated by the customer, physically receives the products.

Where the customer independently appoints a carrier that was not offered by Lovely Stickers, the risk may transfer when the parcel is handed to that carrier, in accordance with applicable law.

13. Withdrawal, returns and refunds

Withdrawal, cancellation, return and refund requests are governed by our Returns, Withdrawal and Refund Policy.

Nothing in these Terms limits any statutory right relating to withdrawal, defective products, non-conforming products, delivery failures or refunds.

14. Legal guarantee of conformity

Consumers benefit from the mandatory legal guarantee of conformity applicable to products sold by a professional seller.

Under French consumer law, a consumer may invoke the legal guarantee of conformity for a lack of conformity that appears within two years from delivery of the product.

Depending on the circumstances and applicable law, the consumer may be entitled to repair, replacement, price reduction or termination of the contract.

Any repair or replacement required under the legal guarantee must be provided without unreasonable inconvenience and without cost to the consumer.

15. Hidden defects

The customer may also benefit from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code.

A hidden defect is a defect that existed at the time of sale, was not apparent when the product was purchased and makes the product unsuitable for its intended use, or reduces that use so significantly that the customer would not have purchased it, or would have paid a lower price, had they known about the defect.

16. Installation and use

The customer must follow the installation instructions provided with the product or made available on the website.

The surface must be suitable, clean, dry and correctly prepared before installation.

Damage caused by incorrect installation, unsuitable tools, excessive heat, inappropriate cleaning products, contaminated surfaces, modification of the product or failure to follow the instructions is not considered a manufacturing defect.

This does not exclude liability where the supplied instructions were incorrect or inadequate, or where the product itself was defective or non-conforming.

17. Website availability

We aim to keep the website available and accurate but cannot guarantee uninterrupted access.

The website may occasionally be unavailable because of maintenance, technical issues, security incidents, third-party services or circumstances outside our reasonable control.

18. Prohibited website use

Users must not:

• use the website for unlawful or fraudulent purposes;
• attempt to access protected systems or customer data;
• introduce malicious code;
• copy, scrape or reproduce substantial parts of the website without permission;
• interfere with the normal operation or security of the website.

19. Lovely Stickers intellectual property

Unless otherwise indicated, the website structure, original text, photographs, product presentations, graphics, templates and original designs created by Lovely Stickers are protected by intellectual property law.

No content may be reproduced, distributed, sold or commercially exploited without prior written permission.

20. Third-party trademarks

Names, logos and trademarks belonging to vehicle, gaming, simulation, motorsport or equipment manufacturers remain the property of their respective owners.

Unless expressly stated, Lovely Stickers is not affiliated with, authorised by, sponsored by or endorsed by those manufacturers.

References to brands or product models may be used to describe compatibility, inspiration or the intended use of an accessory.

21. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Lovely Stickers is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was concluded.

For business customers, and to the extent permitted by law, Lovely Stickers is not liable for loss of profit, revenue, business, opportunity, goodwill or production.

Mandatory consumer rights remain unaffected.

22. Force majeure

Lovely Stickers is not liable for a failure or delay caused by an event outside its reasonable control, including natural disasters, fires, major transport disruption, industrial action, war, government restrictions, power failure, telecommunications failure or serious supply interruption.

This clause does not remove any mandatory right the customer may have to cancel an order or obtain a refund following a prolonged delay.

23. Governing law

These Terms and Conditions are governed by French law.

Consumers residing outside France also retain any mandatory protections granted by the law of their country of residence where those protections cannot legally be excluded.

24. Complaints and disputes

Customers should first contact us in writing so that the issue can be reviewed:

Please include the order number and a clear description of the issue.

If an amicable solution cannot be reached, the customer may use any dispute-resolution procedure or competent court available under applicable law.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

26. Changes to these Terms

We may update these Terms to reflect changes in our business, website, services or applicable law.

The version applicable to an order is the version made available when the order was placed.
